1. Introductions - Attendance: Commissioners Marty Carr, Elihu Harris, Cara Jenkins, Diane Boyer-Vine, Nanci Nishimura, Dan Robbins, Dave Clark, Elena Duarte, Pam Bertani, Senator Thomas Umberg, Nat Sterling, ULC Lindsay Beaver, Benjamin Orzeske

 

2. Adoption of minutes from the October 3, 2022 and June 9, 2023 meetings - Moved and Seconded. The vote was unanimous with Commissioner Elihu Harris not present for the vote.

 

3. Update on enacted legislation (Discussion)
   1. Senate Bill 95 – UCC Amendments
   2. Senate Bill 522 – Uniform Fiduciary Income and Principal Act. (Missing Act in notice and website)
   3. Senate Bill 801 – Directed Trust Act
   4. Senate Bill 95 – Secured Transactions
   5. Assembly Bill 39 – Regulation of Virtual-Currency Businesses Act

 

4. Uniform acts for consideration for introduction in the 2024 legislative session
   1. Uniform Child Abduction Prevention Act – The Commission is interested for introduction in the 2024 legislative session. Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 2. Civil Remedies for Unauthorized Disclosure of Intimate Images Act- The Commission authorized Commissioner Marty Carr to find an author for this act.  Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 3. Health Care Decisions Act – Commissioner Elihu Harris to work with Lindsay Beaver of the Uniform Law Commission to investigate and compare with California Law. Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 4. Power of Attorney Act – Commissioner Diane Boyer-Vine to work with the Uniform Law Commission staff to investigate and compare with existing California law. Commissioner Diane Boyer-Vine to be the liaison with the ULC staff. Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 5. Notarial Acts – Commissioner Diane Boyer-Vine to reach out to the State Bar regarding this act. The Commission will continue to review this Act for future consideration. No vote taken.

 

1. 6. Special Deposits Act – Commissioner Dave Clark to follow up with California Bankers Association regarding this act. The Commission will continue to review this Act for future consideration. Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 7. Fiduciary Access to Digital Assets Act – Commissioner Dave Clark will follow up with California Bankers Association regarding this act. The Commission does not authorize to seek an author for next year. The Commission will continue to review this Act for future consideration. Moved and Seconded.  The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

1. 8. Deployed Parents Custody Act – Commissioner Marty Carr to provide more information to Commissioner Senator Thomas Umberg. Commissioner Marty Carr to work with the ULC staff to put together synopsis for Commissioner Senator Thomas Umberg. The Commission is interested for introduction in the 2024 legislative session. The Commission authorized Commissioner Marty Carr to find an author for this act. Moved and Seconded. The vote was unanimous with Commissioner Senator Thomas Umberg abstaining.

 

5. Discussion of travel-ban repeal – Commissioner Jenkins provided an update on the repeal of the state-wide travel ban. SB 447 (2023) repealed the prohibition and the conflict for commissioners is no longer applicable.

 

6. Election of Chair, Vice Chair - Commissioner Marty Carr will be Chair and Commissioner Nanci Nishimura will be Vice Chair. Moved and Seconded.  The vote was unanimous
