Meeting of the California Commission on Uniform State Laws

Meeting Date: October 3, 2022, 1 p.m. – 3:30 p.m.

Meeting via Zoom

  1. Introductions – The meeting was called to order at 1:02 p.m.  The following commissioners were in attendance:  Pam Bertani, Diane Boyer-Vine, Marty Carr, Dave Clark, Elena Duarte, Elihu Harris, Cara Jenkins, Nanci Nishimura, Nathaniel Sterling, and Senator Tom Umberg.  Others present Lindsay Beaver, Kaitlin Wolf, Libby Snyder, Joanna Varner, Kristen Mills, Ben Orzeske, Alison Merilees, and Michael Rosen-Prinz.

 

  1. Approval of June 30, 2022 meeting minutesA motion was made and seconded to approved the meeting minutes.  The vote on the motion was 7 to 0 with Commissioner Senator Umberg abstained.

 

  1. Discussion of travel-ban memorandum:

 

    1. Commissioner Cara Jenkins updated information regarding travel reimbursement. 2023 travel-ban states for the State of California according to the Attorney General’s Office

 

  1. Update on bills (2021-22 legislative session)
    1. Senate Bill 103 (Commissioner Diane Boyer-Vine) - Uniform Faithful Presidential Electors Act. Signed by the Governor 8/29/2022

 

    1. Senate Bill 1159 (Commissioner David Clark & Michael Rosen-Prinz) - Uniform Fiduciary Income and Principal Act. 2021-2022 bill was not enacted Will be introduced again in the upcoming session year 2023-2024.

 

  1. Uniform acts for consideration for introduction in the 2023-24 legislative session (Commissioner Senator Umberg abstained from voting on Acts and Commissioner Elihu Harris left the meeting)
    1. 2022 Amendments to the Uniform Commercial Code:

Commissioner Diane Boyer-Vine to assist on this act with staff from the ULC Chicago. A motion was made and seconded for introduction in the 2023-24 legislative session. All commissioners voted yes 7 to 0.

 

    1. Uniform Fiduciary Income and Principal Act - Commissioner Dave Clark informed a reintroduction of SB 1159. A motion was made and seconded for reintroduction of act in the 2023-24 legislative session. All commissioners voted yes 7 to 0.

 

    1. Uniform Child Abduction Prevention Act (OLC Deputies) – Motion Fails
      1. Presentation of OLC memorandum on the comparison of this act to existing California law

 

    1. Civil Remedies for Unauthorized Disclosure of Intimate Images Act (ULC Staff)

Commissioner Marty Carr will assist on this act finding an author. A motion was made and seconded for introduction in the 2023-24 legislative session. All commissioners voted yes 7 to 0.

 

    1. Collateral Consequences of Conviction Act - Lindsay Beaver of the ULC discussed the act and informed the commission if act should be introduced. Commissioner Nathaniel Sterling will investigate and report for the possibility of introduction for future legislative session.

 

    1. Criminal Records Accuracy Act - The commissioners discussed this act, but ultimately no motion was made.

 

    1. Deployed Parents Custody Act - The commissioners discussed this act, but ultimately no motion was made

 

    1. Uniform Directed Trust Act Commissioner Dave Clark will work on this act with Michael Rosen-Prinz. A motion was made and seconded for introduction in the 2023-24 legislative session. All commissioners voted yes 7-0.

 

    1. Unregulated Child Custody Transfers Act - Libby Snyder of the ULC discussed this act the Office of Legislative Counsel to do research regarding this act. A motion was made and seconded for introduction in the 2023-24 legislative session. All commissioners voted yes 7 to 0.

 

  1. Alcohol Direct-Shipping Compliance Act - The commissioners discussed this act, but ultimately no motion was made.

 

  1. Adjournment: A motion was made to adjourn the meeting The vote on the motion was 8 to 0. The meeting was adjourned at 3:03 p.m.
