June 30th, 2025 - Meeting Minutes
Chair Carr called the meeting to order at 1:09 p.m.
- Introductions
- Commissioners attending in person: Chair Marty Carr, Vice Chair Nanci Nishimura, Diane Boyer-Vine, Honorable Elena Duarte, Cara Jenkins, and David Clark.
- Commissioners attending via Zoom: Pamela Bertani and Daniel Robbins.
- Approval of minutes
- July 19, 2024 Summer CCUSL meeting minutes. A motion was made and seconded to approve the minutes. Vote: 6-0. Commissioner Robbins abstained due to not attending that meeting. Commissioner Clark was not present for the vote.
- October 28, 2024 Fall CCUSL meeting minutes. A motion was made and seconded to approve the minutes. The minutes were approved by unanimous vote. Commissioner Clark was not present for the vote.
- Quorum rule. Commissioner Boyer-Vine discussed the potential of having eleven commissioners instead of twelve, which would change the quorum requirement to six commissioners. Since the Commission is able to meet in hybrid format until the end of 2025, this topic will be deferred to the upcoming Fall CCUSL meeting.
- Open government laws memo. Commissioner Jenkins provided memorandum to commissioners, which outlines the statutes that apply to the CCUSL. Commissioner Boyer-Vine recommended updating the open records section of the memo.
- MCLE credits. Commissioner Boyer-Vine informed the commissioners that the State Bar will not grant MCLE credits for commissioners participating in the ULC Annual Meetings.
- Excess lodging form. Commissioner Jenkins informed commissioners that they are required to submit excess lodging form in addition to the travel expense form for the upcoming ULC Annual meeting in Santa Fe.
- ULC annual dues payment for 2025-26 FY. Contingent on the approval of the state budget, payment of 2025-26 dues in the amount of $193,424 will be made, which is a three percent increase from the prior year.
- Final Acts at the 2025 ULC Annual Meeting. The CCUSL approved adoption by the ULC of the following acts as uniform state laws:
- Assignment for Benefit of Creditors Act – Chair Carr described the act. A motion was made and seconded that California vote in favor of the act at the vote by the state. The motion was adopted unanimously.
- Judicial Interview of Children Act – Commissioner Clark described the act. A motion was made and seconded that California vote in favor of the act at the vote by the state. The motion was adopted unanimously.
- Model State Uniform Law Commission Act – Commissioner Boyer-Vine described the act. A motion was made and seconded that California vote in favor of the act at the vote by the state. The motion was adopted unanimously.
- Discussion and vote on authorizing chair, vice chair, and legislative liaison to deviate from the decisions reached in Item 8 if information arises after this meeting. A motion was made and seconded. The motion was adopted unanimously.
Adjournment. Commissioner Diane Boyer-Vine made a motion to adjourn the meeting at 2:18 p.m. and the motion was seconded. The motion was adopted unanimously.
