Meeting of the California Commission on Uniform State Laws

Nat Sterling called the meeting to order at 8:00 a.m.
The Chair determined that a quorum was present.
- 2013 Annual Dues
There was discussion about California’s dues for the fiscal year ending June 30, 2014, and the Commission agreed to pay $154,500, which is the full amount invoiced by the ULC. The Commission decided that the issue of the amount of the annual dues should be placed on the agenda for the CCUSL meeting held in the fall. Considerations include why 20% of the dues of other states are in arrears, why ULC has a $2 million surplus, and why there is a 2% increase in dues.
2. California’s Vote on Uniform Acts Proposed at the ULC Annual Meeting
The Commission discussed the acts up for final adoption as uniform acts. Noting the shortness of time allowed for discussion, the Commission decided to schedule for discussion at the fall meeting whether to re-institute a spring meeting of the Commission where acts coming up can be reviewed more in depth.
The Commission agreed to vote as follows at the vote-by-state held on July 11, 2013:
Uniform Act on Prevention of and Remedies for Human Trafficking – Yes
Uniform Powers of Appointment Act – Yes
Uniform Harmonized Business Organization Code – Yes
Amendments to the Uniform Child Custody Jurisdiction and Enforcement Act Pertaining to International Proceedings – Yes
3. Other Administrative Matters
Public Relations. The Commissioners discussed publicity, including a recent article in the Capitol Alert of the Sacramento Bee. The Commissioners agreed to place on the fall agenda a discussion of how press inquiries should best be handled.
Legislature Relations. The Commission noted that legislative members were unable to attend the annual meeting due to the conflict with the Legislature’s meeting schedule, and as a result the Commission’s relation with the Legislature is not as strong as it might be. The Commission decided to schedule for the fall meeting a discussion of the possibility of moving the time of the annual meeting in the future, and of adding a spring Commission meeting at a time when legislators could more easily attend.
Uniform Acts. The Commission reviewed various uniform acts and agreed to schedule a discussion of the following acts for enactment in the fall. The Chair emphasized that the Commissioner proposing the act must prepare in advance a discussion of how the act would fit within the California legal structure and ascertain potential support and opposition.
Uniform Powers of Appointment Act — Dave Clark to take the lead; Nat Sterling to notify State Bar
Uniform Act on Prevention of and Remedies for Human Trafficking — Marty Carr to take the lead
Uniform Enforcement of Foreign Judgments Act — Bob Cornell to take the lead (in particular why California doesn’t get credit for this, or at least for being substantially similar)
2017 Annual Meeting. The Commission met with the ULC President and incoming ULC Executive Committee Chair concerning the possibility of holding the 2017 annual meeting in California. Some Commissioners expressed concern about the fundraising the Commission would be expected to do in order to host the meeting. The Commission agreed it would schedule the matter for discussion at its fall meeting and give the ULC leadership a definitive answer on whether it was for or against hosting the 2017 annual meeting. The Chair agreed to see if the meeting could be held earlier, rather than later, in the fall for this purpose.
