Item 1- Introductions
The roll was called and the following commissioners were physically in attendance: Commissioners Diane Boyer-Vine, Marty Carr, Dave Clark, Bob Cornell, Elihu Harris, Dan Robbins and Byron Sher.
Commissioner Elena Duarte participated by phone. The absent commissioners were Pam Bertani, Rob Bonta, Hannah-Beth Jackson, and Fred Rowley.
Item 2. Dues
The commission discussed the 2017 dues for California, which are $162,100 plus costs for the 2017 meeting in San Diego. These costs are as follows:
- Audio-visual costs of $62,000
- Printing costs of $14,000
Dave Clark made a motion to approve the dues. Nat Sterling seconded the motion. The motion was approved by a unanimous vote. Elihu Harris was not in the room during the vote.
Item 3. Final Acts
Employee and Student Online Privacy Protection Act.
Nat Sterling described the act and moved that California vote in favor of the act at the vote by state. Dave Clark seconded the motion. The motion was adopted unanimously.
Family Law Arbitration Act.
Diane Boyer-Vine described the act and moved that California vote in favor of the act at the vote by state. Nat Sterling seconded the motion. The motion was adopted unanimously.
Foreign Notarization Amendment to the Revised Uniform Law on Notarial Acts.
Marty Carr described the act. Diane Boyer-Vine moved that California vote in favor of the act at the vote by state. Nat Sterling seconded the motion. The motion was adopted unanimously.
Revised Uniform Unclaimed Property Act.
The commissioners discussed the act including prior information that California’s Controller’s opposed a prior version of the act. Elihu Harris moved that California abstain from voting on the act at the vote by state. Marty Carr seconded the motion. The motion was adopted unanimously.
Unsworn Domestic Declarations Act and Unsworn Declarations Act
Dave Clark described the acts. Nat Sterling moved that California vote in favor of the acts at the vote by State. Diane Boyer-Vine seconded the motion. All commissioners voted for the motion with one abstention by Elihu Harris.
Wage Garnishment Act.
Justice Duarte described the act. Diane Boyer-Vine moved that California vote in favor of the act at the vote by the State. Nat Sterling seconded the motion. The motion was adopted unanimously.
Item 4. 2017 Annual Meeting
AV/Printing – Diane Boyer-Vine informed the commission that these costs would be covered by the dues.
Keynote Speaker – Justice Duarte discussed efforts to date. We are seeking elected officials, then a former speaker, and a justice on the California Supreme Court.
Goodie Bags – Elihu Harris will assist Pam Bertani with the goodie bags
Wine donations – Marty Carr described the wine donation he has received.
Item 5. Credit in California for Uniform Acts enacted in the state.
Diane Boyer-Vine described the concern that California Commissioners work on legislation that involve uniform acts, spend state money to do so, and often California does not get credit. Diane Boyer-Vine anticipates this situation with the Uniform Trust Decanting Act.
Dan Robbins described the situation with RUFADAA in California.
After discussion, the commission decided to create a separate category on the web site to identify these acts.
Dave Clark moved to adjourn. Marty Carr seconded the motion. The motion was adopted unanimously.
