Meeting of the California Commission on Uniform State Laws

July 14, 2014 5:45 p.m.

Adjourned July 14, 2014 6:25 p.m.

 

Attendees: Pamela Bertani; Diane Boyer-Vine; Dave Clark; Robert Cornell; Elihu Harris; Dan Robbins; Byron Sher; and Nat Sterling.

 

Dave Clark called the meeting to order at 5:45 p.m.

 

The Chair determined that a quorum was present.

 

  1. 2014 Annual Dues

There was discussion about California's dues for the fiscal year ending June 30, 2015, and the Commission agreed to pay $157,500 which is the full amount invoiced by the ULC.

 

2. California's Vote on Uniform Acts Proposed at the ULC Annual Meeting

The Commission discussed the acts up for final adoption as uniform acts. The Commission agreed to vote as follows at the vote-by-state to be held on July 16, 2014:

Fiduciary Access to Digital Assets Act - Yes

Interjurisdictional Recognition of Substitute Decision-Making Documents Act - Yes

Amendments to Uniform Fraudulent Transfer Act (now called Uniform Voidable Transactions Act) - Yes

Revisions to Uniform Common Interest Ownership Act Section 3-116 - Yes

 

3. Other Administrative Matters

MCLE Credits - The Commissioners discussed the process to obtain MCLE credits for attendance at the meeting. Commissioner Boyer-Vine will determine whether California has listed the state of Washingtion as a state for which it will recognize credits.

2017 Annual Meeting - The Commissioners would like to have more information on the plans for the annual meeting to be held in San Diego, California in 2017 in order to get started early on planning. Commissioner Boyer-Vine agreed to contact the ULC and to place this on the agenda for the fall 2014 CCUSL meeting.

Meeting in Williamsburg, VA - The Commissioners would like to rent cars to get to the meeting in Williamsburg, Virginia. Commissioner Boyer-Vine will determine the rules regarding car rentals and will place this on the agenda for the fall 2014 CCUSL meeting.

Fall 2014 CCUSL meeting - Commissioner Boyer-Vine asked commissioners to provide dates in late September or early October for the fall 2014 CCUSL meeting.
