Present: Commissioner Diane Boyer-Vine, Commissioner Marty Carr, Commissioner David Clark, Commissioner Elena Duarte; Commissioner Elihu Harris, Commissioner; Commissioner Nanci Nishimura ; Commissioner Dan Robbins; Commissioner Nat Sterling

 

  1. Introduction

 

Commissioner Diane Boyer-Vine called the meeting to order.  Commissioner Diane Boyer-Vine asked for a roll call of the California Commission and determined that a quorum was present.

  1. Discussion of Final Acts

 

  1. Common Interest Ownership – Commissioner Marty Carr presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 8 to 0.

 

  1. Unregulated Transfer of Adopted Children – Commissioner Diane Boyer-Vine presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 8 to 0.

 

  1. Uniform Personal Data Protection Act - Commissioner Elena Duarte presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting, The vote was 8 to 0.

 

  1. College Athlete Name, Image, and Likeness - Commissioner Diane Boyer-Vine presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 5 yes votes and 3 abstentions.

 

  1. Covenants Not to Compete - Commissioner David Clark presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 8 to 0.

 

  1. Community Property Disposition at Death - Commissioner Nat Sterling presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 7 to 0 with Commissioner Harris absent during the discussion and vote

 

  1. Economic Rights of Unmarried Cohabitants – Commissioner Diane Boyer-Vine presented the act. A motion was made and seconded for California to vote yes on the act during the annual meeting. The vote was 7 to 0 with Commissioner Elihu Harris absent during the discussion and vote.

 

 

  1. Discussion of delegating authority on final acts during ULC Annual Meeting – A discussion ensued regarding delegating authority to a set of commissioners to revise California’s vote on any particular final act during the annual meeting should the final act change significantly from the form presented during this Zoom meeting. A motion was made and seconded to authorize the commissioners who will be physically present at the meeting to consider and change the vote on any final act that changes significantly. Any vote by the four commissioners must be unanimous. The change in procedure is in place only for the ULC annual meeting in Madison, Wisconsin. The vote was 7 to 0 Commissioner Elihu Harris was not present for discussion and vote.

 

  1. Discussion of annual ULC dues – A motion was made to pay California’s full dues for the upcoming year with the caveat related to prohibiting California’s dues from being used for ULC meetings in travel-ban states. Commissioner Nat Sterling queried whether the ULC provided a report to the California Commission based on last year’s request for a full report on the fiscal effect of canceling meetings during the

 

COVID-19 pandemic. Commissioner Dan Robbins provided an assessment of the fiscal effect of canceling meetings. A vote was taken on the motion to pay the dues. The vote was 7 to 0 with Commissioner Elihu Harris absent during the discussion and vote. Commissioner Boyer-Vine indicated that she would inform the Legislative Counsel of the motion and vote and request payment of the dues.

 

Adjournment: The Commission, by 7 to 0 vote adjourned at 3:48 p.m. Commissioner Elihu Harris was not present for this vote.
